operates an online shop for clothes and accessories through WWW.2ALLY.ME. The following conditions apply to users in the case of orders.
2. Sealing a contract
2.1 The presentation of products in the online shop does not comprise a legally binding offer but a request to order. Errors and changes are no violations.
2.2 By clicking on the ordering button in the last state of the process of ordering, you make a binding offer to buy the wares put in the basket. But the purchase agreement becomes binding only when we expressly accept the offer or deliver the wares ordered.
2.3 As confirmation of your offer we send you fully and promptly the details of your order by email. You can view, save and print our general conditions of business at any time, and you can view your current orders in our customer log-in area once you have registered.
3. Prices and conditions of payment
3.1 The prices given on our product pages include the mandatory value added tax and all other price components apart from the costs of delivery.
3.2. The purchase price becomes due with the declaration of acceptance. Payment can be made, according to your choice, in advance, by credit card, eps (only in Austrai), Postfinance (only in Switzerland), Paypal or direct banking. If payment is made by credit card, the money is withdrawn from your account at the time of delivery.
4. Delivery to lands outside the EU
4.1 For deliveries to non-EU lands no value-added tax is included in the prices.
4.2 For deliveries to non-EU lands there are further taxes and fees for you to pay.
5. Costs of delivery
5.1 In addition to the prices given we charge 4.90 € per order for delivery within Germany.
5.2 For deliveries outside Germany we charge additionally per order:
12.50 €: Belgium, Denmark, Luxembourg, Netherlands
19.00 €: Andorra, Finland, France, Greece, Great Britain, Ireland, Italy, Austria, Poland, Portugal, Sweden, Spain
25.00 €: Bulgaria, Latvia, Lithuania, Hungary, USA
30.00 €: Canada, Iceland, Liechtenstein, Norway, Switzerland
35.00 €: Estonia, Malta, Czech Republic, Cyprus
40.00 €: Australia, Bosnia-Herzegovina, China, Hong Kong, Israel, Japan, Croatia, Kuwait, Russia, South Korea, Saudi Arabia, Ukraine
6.1 Delivery within Germany is done by DHL. By registering you can view the status of any delivery underway.
6.2 The same is true of delivery abroad.
6.3 If delivery fails after two tries, we retain the right to withdraw from the agreement. If appropriate we promptly repay any payments made.
6.4 If the product is not available, due to our supplier, not us, we retain the right to withdraw from the agreement. In the event of withdrawal, we shall inform you at once and, if appropriate, offer to deliver a similar product. If none is available or you have no wish to have any, we shall, if appropriate, promptly reimburse any payments made.
6.5 Till payment is made in full, the product ordered remains the property of 2ALLY.ME GmbH.
We are liable for no damages owing to the agreement or its implications, for offences or other legalities, apart from harm to a person's life, body or health, be it with intent or due to gross negligence on the part of 2ALLY.ME GmbH or of persons helping to fulfil its obligations or to neglect of an obligation crucial to achieving the agreement's aim. These stipulations have no bearing on other legally binding claims for liability such as those covered by the product liability law.
8. The law applicable
This is the German one, save for the UN sales law.
9. Cancellation policy
The right of cancellation applies only for users according to § 13 BGB. A user is any natural person carrying out a legal transaction for a purpose unrelated to his or her commercial or freelance professional activity.
RIGHT OF WITHDRAWAL
You have the right to withdraw from this agreement within fourteen days without saying why.
The period of revocation amounts to fourteen days from the day on which you or a third party named by you, who is not the carrier, received the last product.
To exercise your right of withdrawal you must inform us, 2ALLY.ME GmbH, Fasanenstraße 35, 10719 Berlin, Germany, INFO@2ALLY.ME, telephone 0049.30.609 875 200, fax 0049.30.609 875 209, about your decision to withdraw from the contract and give a clear reason for doing so, be it in a letter sent by post, telefax or email and so on. You are welcome to use the attached standard form but are not forced to.
To exercise this right within the period of revocation, it is enough for you to inform us before the end of the period.
CONSEQUENCES OF WITHDRAWAL
If you revoke this agreement, we have to pay back any payments received and to do so promptly or at the latest within fourteen days of receiving your notification. Payments include the costs of delivery, save for any additional costs due to your having chosen a means of delivery other than the inexpensive one offered by us as standard.
For repayment we use your own means of payment in the original transaction unless you call for another. Either way, you will not charged for repayment.
We have the right to refuse repayment before receiving the returned product or proof or return, whichever is the earlier event.
You have to send the product back or hand it over to us promptly or at the latest within fourteen days of your notification of withdrawal from the agreement. This applies to the date on which you send the product back or hand it over. We cover the costs of sending it back within Germany.
If the returned product has lost some value, you have to pay for the difference only if scrutiny of the nature, properties and functions of the product reveal that the loss in value is due to needless behaviour on your part.
